Annotation: The digital economy and the development of artificial intelligence are leading to a dramatic increase in the importance of data and datasets. However, their use is associated with a number of legal issues. The course will provide participants with a practical overview of the legal regulation of datasets and will focus in particular on the possibilities of their licensing and legal use in practice.
Course content:
1. What is a dataset and what are its legal characteristics:
- the difference between individual items, a database and a data set,
- copyright protection and the special right of the database creator.
2. Dataset licensing:
- an overview of the most common open licenses (Creative Commons, Open Data Commons, EU Open Data License),
- practical impacts of license terms: attribution, share-alike, prohibition of commercial use, combination of multiple licenses, o licensing of datasets created on order or within the framework of an employment relationship.
3. Legal risks of working with datasets:
- personal data and GDPR,
- trade secrets and confidentiality,
- liability for unauthorized use.
4. Practical examples and case studies on:
- licensing datasets for research and development purposes,
- on using data for AI training,
- on resolving conflicts between different licenses.
